In 2014, Samantha Geimer, the victim in the case, asked the court to unseal transcripts of then-Deputy District Attorney Roger Gunson’s deposition and investigate the alleged miscarriage of justice. Geimer has been informed of the court’s decision, the prosecutor’s office said. “My request has been repeatedly denied. I have been told that Mr. Polanski must be turned over to US authorities in order for misconduct in this case to be investigated. Furthermore, the testimony must remain sealed unless an investigation is conducted. I believe this response is disingenuous ,” Geimer wrote to the LA district attorney’s office last month as she pushed for information to be released. “This case has been described by the courts as ‘one of the longest-running sagas in California criminal justice history,’” Gascon said in a statement Tuesday. “For years, this office has fought for the release of information that the victim and the public have a right to know. After careful consideration of the victim’s wishes, the unique and extraordinary circumstances that led to probation, and my commitment to transparency and accountability for All in the judicial system, my office has determined that it is in the best interests of justice to agree to the unsealing of these transcripts.” In a 2010 interview with CNN, Geimer said she didn’t want to deal with the media circus surrounding the director if he were ever to return to the US and thought the judge in Polanski’s case was being unfair to him. “We are pleased that the appellate court agreed with both the victim and our office regarding the need for transparency,” Gascon said in response to the ruling. “The court’s decision has helped us uphold our responsibility to tell the truth to the public and listen to survivors. We hope it gives her a little reassurance that she can finally find closure in this decades-long trial.” The office is not sure when or how quickly the court will unseal the documents. The prosecutor said Tuesday that he would no longer object to the unsealing of the transcripts and filed a motion in court asking for their release. “The Gunson hearing was essentially a post-plea evidentiary hearing on judicial and prosecutorial misconduct — rather than a conditional hearing to preserve a victim or witness’s testimony for trial — and the security issues that often exist in cases where examinations are used parolees are not present in this case,” Gascon said in his deposition. “So the transfer should be unsealed.” CNN has reached out to Gunson for comment.
