An alleged fall at her local Walmart has led a Penticton woman to file a lawsuit against the company, claiming she slipped and injured herself in its store. Cheryl Fraser alleged in the lawsuit filed this week that on June 22, 2020, she entered the Walmart located at 275 Green Avenue West around 2:30 p.m. and shopped in the dairy department. While walking in the section, she slipped on the yogurt and fell. The lawsuit alleges that Walmart was negligent and failed to keep store premises safe. The civil suit alleges that Fraser suffered injuries to her right knee, right arm, back, neck, shoulders and chest, along with other injuries that caused her to endure pain, suffering and loss of enjoyment of life with ongoing medical care. She also claims that she suffered impairment and interference with her occupation, resulting in loss of income. Fraser is seeking unspecified general and special damages, the cost of health care services (past and future) and other relief. None of the allegations contained in the lawsuit have yet been proven in court.
